Would You Confuse These Two "Nude" Lines?

It's the battle of the nudes, but in the most G-rated of senses. Designer Stella McCartney is being sued over the use of this stripped-down word. Her new scent, StellaNude Eau de Toilette Spray ($43 to $81) is the product in question.

According to Bono's wife, Ali Hewson, who is the co-founder of Nude Skincare Stella's new fragrance is a bit too similar in terminology. A suit has been brought forth over the use of the word, and Stella's company would like to see it settle out of court.

But do Hewson and her partner have much of a case? The concept of nude-toned clothing is a large theme of Stella's fashions, and nude is a rather common word, after all. Plus, one brand is skincare and the other is a fragrance. What do you think? Would you be confused by these two nude lines, or does Hewson not even have a case?

Nude is a *huge* word in the beauty world - I mean, can Bobbi Brown sue them both, since she's been advocating "nude makeup" for decades now? And how many cosmetic lines can you name that *don't* have some shade with the word "nude" in it? I think this is a bit silly...

Ali Hewson can eff off. Seriously. What a stupid thing to sue over. And as if it's going to affect her sales and as if she needs the freaking money. Disgusting.

I'm a HUGE fan of the Nude skincare line (although can't afford it, bitter rolleyes) and it's a real pain to find info on the Internet or in shops because if you type or ask for "nude skincare" you end up with with tons and tons of irrelevant beauty answers. This being said, that's what you get for picking a word like that for your brand. :P And when you see the two products together, it's pretty obvious they're not related. Also it's pretty funny how there's a lawsuit going on, when these two probably hang out on a regular basis. :P

i highly doubt stella mccartney meant to allude to the new skincare line, and this is perfume vs. skincare. she already has her own skincare line as well. this reminds me of the bond no. 9 suit about a small perfumer using the word "peace." scent of peace is a nice perfume, but it does not reserve a common word in the english language.

If the name was trademarked and they are considered to be in the same category, then they might have a case. Is she going to sue Dior too for the Nude makeup? A former boss trademarked the name Access in luggage and years later Microsoft sued and lost. Morey Boogie also lost when they sued Mesa Boogie and Mesa Boogie didn't even have a trademark. Morey Boogie now has to pay Mesa Boogie to use the name Boogie.

The Twilight perfume/Nina Ricci perfume is a valid lawsuit because the packaging is intentionally misleading. In this case, there clearly wouldn't be confusion. The word nude already existed. It's a frivolous lawsuit.

Stella has had her perfume on the market since when... 2003? That's a long time, and she has built her reputation with her clothing line as well. Why a new comer would sue is just plain stupidity, and a waste of time/money.

No one says, "Hey, I just bought Nude from the beauty store!" It's just a common word for hells sake! Companies are so sue happy now that the economy is going down the toilet!
